There are many reasons why people miss their rental payments, usually because of unexpected financial emergencies. A loss of a job, unemployment not timely processing a claim, a major car repair, medical emergency, or other unplanned life events can cause you to fall behind. Nevada now has an Eviction Mediation Program to help tenants. And there are always bankruptcy options that may also give you more time.
In 2020, in response to the global pandemic, the Nevada Legislature created an eviction mediation program. A tenant has a right to use this program to try to avoid an eviction. The Eviction Mediation Program is designed to help you meet with your landlord, explain your situation, and with the help of a mediator, work towards a resolution so you do not end up on the street. This will also help you avoid an eviction on your credit report, which can make it harder to rent a new location in the future. Even if you are planning on leaving, this program may help you establish a more definite time line on when you will need to leave, so that you don’t need to worry about a police officer showing up unexpectedly at your door forcing you to leave.
And, if the mediation does not work, there are bankruptcy options that may also give you the opportunity to finish your lease, or at least have additional time before you have to move. The automatic stay in bankruptcy can stop the eviction process and give you a breathing space to plan your next move. And in a Chapter 13 bankruptcy, you may be able to assume your lease and propose to re-pay the amount you are behind over time.
